What is tenant insurance?

Tenant liability insurance (OC Najemcy in Polish) is a comprehensive policy designed for individuals renting a home. It protects against damage accidentally caused to a third party (e.g. the property owner) by the tenant, household members and pets living in the property. It also covers damage accidentally caused outside the rented property.

Tenant insurance covers damage to the apartment

Tenant insurance is still a relatively new product in the Polish rental market. It’s a modern and practical solution, though based on well-established principles. It works well as a complement to the deposit. It won’t cover unpaid utility bills or other financial obligations, but it does help cover damage to the apartment or surrounding property, whether accidental or due to negligence.

The damage must be sudden, accidental and when you are at fault. Tenant liability insurance covers civil liability in private life, i.e. it must relate to damage to third parties, such as the property owner or a neighbour. It does not cover intentional or long-term damage, caused when under the influence, or damage resulting from wear and tear.

  • Your dog tears the sofa, which belongs to the property owner.
  • You trip in the shower and break the door.

You just need to remember to report the damage. Drivers know what to do after a collision, but reporting home-related damage isn’t always obvious.

How to report damage in a rented property in Poland?

Claims can be made by both the insured party (e.g. the tenant) and the injured party (e.g. the property owner) within a maximum of 7 days from when the damage occurs or is discovered. The insurer will request a statement by the person responsible for the damage.

This includes coverage for personal belongings brought into the rental – in case of damage, flooding, theft. Thanks to such insurance, you could repair or replace electronics, clothes, kitchen gear, tools, and other essentials.

For convenience, some policies also provide access to specialists – locksmiths if you’re locked out, plumbers if something leaks, or legal support when needed. Legal protection and expert advice included in the insurance can be more reliable than random suggestions found on social media.

How much does tenant insurance in Poland cost?

Tenant insurance from simpl.rent – a gift-like benefit

You can even buy tenant insurance for someone else. You can require your tenant to purchase it in the rental agreement, but enforcing this can be tricky – for example, if the tenant forgets to buy the policy within 7 days of moving in, it rarely results in lease termination.

A better option might be for the landlord to buy it for the tenant and agree on the reimbursement. Both parties gain peace of mind knowing the insurance exists, and damage can be covered from the policy. It’s important that the landlord knows the policy number and tenant’s details so they can file a claim directly if needed. Transparency and communication are key for this insurance to serve both sides of the rental agreement.

How to require tenant insurance in a Polish rental agreement?

If tenant insurance is required, the rental agreement should clearly state that. Since this insurance complements the deposit, you can include a clause in the deposit section like:

Before the rental begins, the Tenant agrees to provide the Landlord with details of the tenant insurance (insurer name, policy number, insured person, coverage period and amount). If the policy expires during the rental, the Tenant agrees to renew it immediately and inform the Landlord without further request.

You can add provisions stating the landlord won’t hand over the keys without proof of insurance, or that the landlord may purchase the policy on behalf of the tenant, who would then reimburse the cost. In all cases, clear communication is key – purchasing the policy takes just a few clicks and can be active from the following day from the day of purchase.

Note: most tenant liability policies in Poland are valid for one year. If your lease is slightly longer or extended via annex, the policy should also be renewed or extended.

Tenant insurance is a valuable add-on for the entire Polish rental market. It protects both tenant and landlord, eliminates many disputes, and lets the insurer handle damage claims based on expert opinions rather than emotional arguments.
