What if the tenant doesn't want to purchase a policy?

It all depends on your terms. If in the listing or agreement you specify that tenant liability insurance is mandatory, the tenant must purchase it to receive the keys. Their refusal simply means declining to rent on your terms. It's worth presenting this to the tenant as a mutual benefit – the cost of the policy is usually a few dozen PLN a year, and it protects their wallet from enormous costs if they accidentally flood the apartment or damage your furniture.

How do I make a claim in the event of an accident?

A claim on tenant liability insurance can be made by either the insured (e.g. the tenant) or the injured party (e.g. the property owner). The claim should be reported within 7 days from the moment the damage occurred or was noticed. You can make the report through your simpl.rent account – just fill in the form and attach the required documentation. Your report will be forwarded to the claims department, and you will receive an individual case number by email.

Will I receive confirmation that the tenant has purchased insurance?

Yes. If the insurance was purchased using an invitation sent to the tenant, you will receive confirmation of an active policy.

Who covers the cost of tenant insurance?

The landlord can purchase insurance on the tenant's behalf, however the standard is that the cost of the policy is covered entirely by the tenant, as the insurance is issued in their name and protects their civil liability. It is advisable for the landlord to have their own liability insurance (available e.g. as part of rent payment insurance ). From the tenant's perspective, it's a small expense (usually a few dozen PLN a year) that protects them from paying out of their own pocket for any damage, such as flooding a neighbour or damaging the apartment's furnishings.

Does tenant liability insurance replace the deposit?

Tenant liability insurance is an additional form of security but will not replace the deposit. It can be a source of covering damage and repair costs in the apartment, but not all of them. In Poland it is generally accepted that the deposit has a broader role – it can cover all other dues (including unpaid utility bills, outstanding rent, interest on these obligations, costs of removing defects, intentional damage).
